FUNDAY x Mr Whippy – Ice-Cream for Cash Competition

The Promotion is run by BETTER CONFECTIONERY PTY LTD ABN 97 640 670 506; Suite 3301, 404 High St, Windsor VIC 3181 (Promoter).

Information on how to enter and the Prize details form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

If you are an eligible person and satisfy all entry requirements set out below, then, subject to these Terms and Conditions, you can enter the competition draw for the chance to win a prize (Promotion).

Entries into the Promotion open at 12:00am AEDT on 15 October 2026 and close at 11:59pm AEDT on 28 October 2026 (Promotional Period).

Entrant Requirements

Entry to the Promotion is open to all Australian Residents who are at least eighteen (18) years old at the time of entry, have a valid email address and mobile number, and comply with the ‘Entry’ provisions set out below. An ‘Australian Resident’ means a person who resides in Australia at the start of the Promotional Period and holds Australian citizenship or holds an Australian permanent residency visa.

Employees, directors, officers, and their immediate family and respective household members, of:

the Promoter and/or CW RETAIL HOLDINGS PTY. LTD (Promotional Partner)

the related bodies corporate of the Promoter and CW RETAIL HOLDINGS PTY. LTD; and

any advertising or promotion agencies of the Promoter and CW RETAIL HOLDINGS PTY. LTD,

are not eligible to enter.

‘Immediate family’ means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister, or first cousin.

It is the responsibility of all entrants to ensure they are eligible under all applicable laws to accept the prize offered as part of the prize draw.

Entry into the competition is free, subject to the entry requirements.

Entry into the Promotion

To enter the Promotion and be eligible for the Prize Draw, entrants must, during the Promotional Period:
a. Purchase any Funday™ Foamy Strawberry and Vanilla Flavoured Ice Cream Gummies 50g pack from a Participating Chemist Warehouse Store in Australia (including Chemist Warehouse Online) and retain their receipt; and
b. Visit https://www.fundaysweets.com/pages/ice-cream-for-cash-giveaway and complete the online entry form by providing their full name, valid email address, proof of purchase (receipt upload) and a contact mobile phone number.

For the purposes of these terms and conditions, “Participating Chemist Warehouse Stores” means Chemist Warehouse retail stores in Australia and Chemist Warehouse Online operated by CW Retail Holdings Pty Ltd.

Each valid purchase and completed entry form equals one (1) entry (Standard Entry). Multiple Standard Entries are permitted, subject to one (1) Standard Entry per eligible purchase.

The use of any automated entry software, mechanical, electronic or other devices that allow an individual to automatically enter the Promotion is prohibited and will invalidate all entries submitted by that individual.

Entries must be submitted in the entrant’s own name. The Promoter may request proof of purchase or entrant details (including an entrant’s identity, age and place of residence) to verify valid entries.

Each entry must be made in accordance with these Terms and Conditions. By entering the Promotion, each entrant agrees to be bound by these Terms and Conditions. The Promoter may, at its discretion, refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.

Ice-Cream Challenge Bonus Entry

Entrants who have submitted at least one (1) valid Standard Entry may receive one (1) additional Bonus Entry into the Prize Draw by completing the FUNDAY x Mr Whippy Ice-Cream Challenge during the Promotional Period.

To receive the Bonus Entry, the entrant must:

a. Create an original video featuring themselves and another person trying FUNDAY x Mr Whippy Foamy Strawberry and Vanilla Flavoured Ice Cream Gummies, during which the entrant surprises the other person with an unexpected scream (the “FUNDAY x Mr Whippy Ice-Cream Challenge”), in accordance with any additional Challenge instructions published by the Promoter at @fundaysweets on TikTok and Instagram;

b. Publish the video during the Promotional Period as an Instagram Reel or TikTok post from their own Instagram or TikTok account;

c. Include the campaign hashtag #FUNDAYIceCreamForCash in the caption;

d. Tag the official @fundaysweets social media accounts in the post or caption;

e. Ensure the relevant social media account and post are publicly viewable so that the Promoter can verify the Bonus Entry; and

f. Submit the URL to the relevant Instagram Reel or TikTok post, together with their relevant social media handle, through the Promotion entry form or other Bonus Entry mechanism specified by the Promoter before the end of the Promotional Period.

Only one (1) Bonus Entry per eligible entrant is available during the Promotional Period, regardless of the number of Ice-Cream Challenge posts published or Standard Entries submitted.

A Bonus Entry is only valid where the entrant has also submitted at least one valid Standard Entry.

The relevant social media account and Ice-Cream Challenge post must remain publicly accessible until 14 days after the Prize Draw, or until the Promoter has completed verification of the winning entry, whichever occurs later.

If the Promoter cannot access or reasonably verify the relevant post when validating entries, the Bonus Entry may be deemed invalid.

Use of the campaign hashtag, tagging FUNDAY, or publishing an Ice-Cream Challenge post alone does not constitute a valid Bonus Entry. The entrant must also submit the relevant post URL through the Promotion entry mechanism.

Ice-Cream Challenge Content Requirements

Any Ice-Cream Challenge entry must be the entrant's own original Content.

The Content must not, in the reasonable opinion of the Promoter:

be unlawful, defamatory, obscene, offensive, discriminatory or otherwise inappropriate;

contain material which is likely to damage the reputation of FUNDAY or Mr Whippy;

infringe any intellectual property, privacy, publicity or other rights of any third party;

depict dangerous, reckless or unlawful behaviour;

feature another identifiable person without that person's consent;

include third-party branding, copyrighted material or music which the entrant does not have permission to use in connection with the Promotion; or

otherwise be inconsistent with the spirit and intent of the Promotion.

The Ice-Cream Challenge is intended to be a fun social activity and must be completed safely.

Entrants must not undertake any activity which could reasonably create a risk of injury to themselves or another person in order to complete the Challenge.

The Promoter reserves the right to determine whether a Bonus Entry complies with these requirements and may invalidate any Bonus Entry that does not comply.

Prize

There will be one (1) winner.

The winner will receive:

AU$10,000 cash.

The total Prize pool is AU$10,000.

The Prize will be paid by electronic funds transfer into an Australian bank account held in the winner's name.

Before payment of the Prize, the winner must provide the Promoter with the information reasonably required to verify their identity, eligibility and nominated Australian bank account details.

The Promoter may require reasonable evidence that the nominated account is held in the winner's name.

The Promoter will not be responsible for any delay, loss or misdirection resulting from incorrect bank account details supplied by the winner.

The Prize is personal to the winner and cannot be transferred or assigned to another person.

The winner is responsible for any tax liability which may arise as a result of receiving the Prize and should obtain their own independent taxation or financial advice if required.

Prize Draw

The winner will be selected at random from all valid Standard Entries and valid Bonus Entries received during the Promotional Period.

The Prize Draw will be conducted via a random electronic drawing method at 9:30AM on 2 November 2026 at 111 High Street, Prahran VIC 3181.

Prize Awarding

The winner will be notified in writing using the email address or other contact details supplied when entering the Promotion within five (5) business days of the Prize Draw.

The winner's surname, initial of their first name and postcode will be published at https://www.fundaysweets.com/pages/ice-cream-for-cash-giveaway within the period required by applicable law.

The winner must respond to the Promoter's notification and provide any details reasonably required to verify their identity and eligibility in order to claim the Prize.

The winner must also provide the Australian bank account details required for payment of the Prize.

Once the Promoter has verified the winner's eligibility and entitlement to the Prize, the Promoter will arrange payment of the AU$10,000 Prize to the winner's nominated Australian bank account within the timeframe required by applicable law.

If the winner:

does not satisfy these Terms and Conditions;

cannot be contacted;

does not provide the information reasonably required to verify their eligibility;

does not claim the Prize within the applicable claim period; or

otherwise forfeits the Prize in accordance with applicable law,

the Promoter may conduct an unclaimed Prize Draw.

Any unclaimed Prize Draw will be conducted at 9:30AM on 2 February 2027 at 111 High Street, Prahran VIC 3181, subject to any applicable requirements or directions of relevant regulatory authorities.

All valid non-winning entries from the original Prize Draw will be eligible for the unclaimed Prize Draw.

Any winner of an unclaimed Prize Draw will be notified in writing using the contact details supplied when entering the Promotion within the period required by applicable law.

Where required, the winner's surname, initial of their first name and postcode will also be published at https://www.fundaysweets.com/pages/ice-cream-for-cash-giveaway.

Entry Verification

The Promoter reserves the right, at any time, to verify the validity of entries and entrants, including an entrant's identity, age, place of residence, proof of purchase and compliance with these Terms and Conditions.

The Promoter reserves the right to invalidate any entry which it reasonably determines:

has not been submitted in accordance with these Terms and Conditions;

contains incorrect, incomplete, fraudulent or misleading information;

relies on invalid or duplicate proof of purchase;

has been generated through automated or prohibited means;

is associated with manipulation of the entry process;

involves impersonation of another person; or

otherwise interferes with the fair conduct of the Promotion.

The Promoter is not responsible for any social media account settings, deleted or removed posts, platform outages, suspended accounts, technical restrictions or other circumstances that prevent the Promoter from accessing or verifying an Ice-Cream Challenge post.

User-Generated Content

Entrants agree that they are fully responsible for any material they create, submit or publish in connection with the Promotion, including comments, photographs, videos, recordings and images (Content).

The Promoter will not be liable in any way for such Content to the full extent permitted by law.

The Promoter may remove, reject or decline to use any Content without notice where it reasonably determines that the Content is inappropriate or does not comply with these Terms and Conditions.

Entrants warrant that:

their Content is original to them or they otherwise have all necessary rights and permissions to submit and publish it;

publication and use of the Content in accordance with these Terms and Conditions will not infringe the rights of any other person;

any identifiable person appearing in the Content has consented to appearing in the Content and to the Content being submitted in connection with the Promotion; and

their Content complies with the applicable rules, terms and community guidelines of Instagram or TikTok.

By submitting Content in connection with a Bonus Entry, the entrant grants the Promoter a non-exclusive, royalty-free, worldwide licence to reproduce, publish, communicate, adapt and display that Content for the purpose of administering, promoting and publicising the Promotion and its outcome.

The entrant also grants the Promoter the right to provide the Content to Mr Whippy for the purpose of promoting or publicising the FUNDAY x Mr Whippy collaboration and the Promotion.

Entrants consent to the Promoter using their name, likeness, image and/or voice if they are the winner, including photographs, film or recordings, in any media for a reasonable period and without additional remuneration for the purpose of promoting the Promotion, its outcome and the FUNDAY x Mr Whippy collaboration.

Exclusion of Liability

To the full extent permitted by law, the Promoter will not be liable for any injury, damages, expenses or loss whatsoever, whether direct or consequential, suffered by any person as a result of entering the Promotion or accepting or using the Prize.

The Promoter is not responsible for any incorrect or inaccurate information or for any equipment or programming associated with or utilised in the Promotion, or any technical error that may occur in the administration of the Promotion.

The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorised access to or alteration of entries.

If for any reason any aspect of the Promotion is not capable of running as planned, including because of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure, war, terrorism, state of emergency, disaster or any cause beyond the reasonable control of the Promoter, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion, subject to applicable law and any requirements or directions of a relevant regulatory authority.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided under the Competition and Consumer Act 2010 (Cth), or any other right or remedy which cannot lawfully be excluded.

Except for any liability that cannot by law be excluded, the Promoter, including its officers, employees and agents, excludes all liability, including negligence, for any personal injury or any loss or damage, whether direct, indirect, special or consequential, arising in any way out of the Promotion.

Without limiting the preceding paragraph, the Promoter is not responsible for and excludes liability, to the extent permitted by law, for:

technical difficulties or equipment malfunction, whether or not under the Promoter's control;

theft, unauthorised access or third-party interference;

any entry or Prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter;

any tax liability incurred by a winner or entrant; or

the acceptance or use of the Prize.

Data Collection and Privacy

The Promoter collects personal information (PI) in order to conduct and administer the Promotion.

For this purpose, the Promoter may disclose PI to relevant third parties including its agencies, contractors, service providers, prize administrators and regulatory authorities as reasonably required to conduct the Promotion.

The Promoter may also disclose limited PI to Mr Whippy where reasonably necessary for the administration, verification, publicity or reporting of the FUNDAY x Mr Whippy Promotion.

Entry is conditional on providing the PI required to administer the Promotion.

The Promoter will collect, use and handle PI in accordance with FUNDAY's Privacy Policy available at:

Where an entrant submits an Instagram or TikTok handle and post URL in order to claim a Bonus Entry, this information will be collected and used for the purposes of administering and verifying that Bonus Entry.

Any direct marketing communications sent to entrants will be handled in accordance with applicable privacy and direct marketing laws and the Promoter's Privacy Policy.

The Privacy Policy contains information about how entrants may access, update or correct their PI, how they may make a complaint about the handling of their PI and how such complaints will be dealt with.

All entries become the property of the Promoter.

The Promoter may disclose entrant PI outside Australia where permitted by applicable law and in accordance with its Privacy Policy.

Instagram and TikTok

The Promoter and entrants acknowledge that the Promotion is in no way sponsored, endorsed, administered by or associated with Instagram or TikTok.

Entrants release Instagram and TikTok from any liability arising in connection with the Promotion to the extent permitted by law.

Entrants must comply with all applicable Instagram and TikTok terms, policies and community guidelines when creating, publishing or submitting Content in connection with the Promotion.

Any questions, comments or complaints regarding the Promotion must be directed to the Promoter and not to Instagram or TikTok.

General

The Promoter reserves the right to validate and check the authenticity of all entries.

Incomplete, indecipherable, fraudulent or otherwise non-compliant entries may be deemed invalid.

Any attempt to manipulate the entry process, artificially generate entries, submit duplicate or fraudulent Bonus Entries, impersonate another person or otherwise interfere with the fair conduct of the Promotion may result in all entries associated with that entrant being deemed invalid.

The Promoter's decision is final, subject to applicable law, and no correspondence will be entered into.

This Promotion is governed by the laws of the Australian States and Territories in which it is conducted, and the parties submit to the non-exclusive jurisdiction of those courts.
